1. Who we are

The Brand Hawk ("we", "us") is a performance marketing agency based in Jaipur, Rajasthan, India, founded by Priyanshu Vyas. We help D2C and ecommerce brands in India, Australia and New Zealand with paid ads, creatives, social media and websites.

This policy explains what personal information we collect through thebrandhawk.com and while delivering our services, how we use it and the choices you have.

2. Information we collect

Information you give us

• Name, email, phone or WhatsApp number, company name and website when you contact us, fill a form, message us on WhatsApp or book a call through Calendly.
• Anything you choose to share about your business, such as ad budgets, goals and sales figures.

Client account data

• When you work with us and give us partner access to your Meta, Google, TikTok, LinkedIn, Shopify or analytics accounts, we can see campaign, audience and sales data. We use it only to deliver the services you hired us for.

Information collected automatically

• IP address, browser, device, pages visited and how you arrived on our website, collected through cookies and similar tools such as Google Analytics and the Meta Pixel. See our Cookie Policy.

3. How we use your information

• To reply to your enquiry and schedule calls.
• To audit, plan, run and report on your marketing campaigns.
• To send proposals, invoices and service updates.
• To improve our website and measure our own advertising.
• To send occasional updates you have asked for. You can opt out at any time.
• To meet legal, tax and accounting obligations.

We never sell your personal information.

4. Consent and legal grounds

We process personal information with your consent, or where it is needed to provide services you have asked for, to meet a legal obligation, or for our reasonable business purposes. You can withdraw consent at any time by emailing us. Withdrawing consent does not affect processing that already happened.

5. Who we share it with

We share information only with trusted providers that help us run our business, and only as much as they need:

• Website hosting and WordPress plugins.
• Google (Analytics, Workspace, Ads), Meta, Calendly and WhatsApp.
• Advertising platforms, when running your campaigns with your authority. For example, uploading hashed customer lists to build audiences.
• Professional advisers such as accountants and lawyers.
• Authorities, when required by law.

6. International transfers

We are based in India and work with clients in Australia and New Zealand. Our service providers may store data in other countries. When information moves across borders, we take reasonable steps to make sure it stays protected in line with this policy and the laws that apply to you.

7. How long we keep it

• Enquiries that do not become projects: up to 24 months.
• Client records: for the length of our engagement and as long as tax and accounting laws require afterwards.
• Access to your ad and store accounts: removed when our engagement ends, or earlier if you ask.

8. Security

We use reasonable technical and organisational measures to protect your information, including limited access, strong passwords and two factor authentication on ad and business accounts. No method of transfer or storage is completely secure, so we cannot guarantee absolute security.

9. Your rights

Depending on where you live, you can ask to access, correct or delete your personal information, withdraw consent, or make a complaint. To do this, email us and we will respond within the time the law requires.

• India: Digital Personal Data Protection Act, 2023. You can also approach the Data Protection Board of India.
• Australia: Privacy Act 1988 and the Australian Privacy Principles. You can also contact the Office of the Australian Information Commissioner (OAIC).
• New Zealand: Privacy Act 2020. You can also contact the Office of the Privacy Commissioner.

10. Children

Our website and services are meant for businesses and adults. We do not knowingly collect personal information from anyone under 18.

We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated at the top.
